Contact the Property Management for details.<\/strong><\/p>\n\n\n\n<p><strong><a href=\"http:\/\/www.berkshire-ridge.com\/wp\/2028-10-23-dca-inspections\/\" data-type=\"page\" data-id=\"2981\">Next DCA Inspection &#8211; October 23, 2028<\/a><\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>A letter dated May 6,2024 was sent to each association member that was in violation with the initial DCA Inspection<\/strong><\/li>\n\n\n\n<li><strong>Corrective Action required.<\/strong><\/li>\n\n\n\n<li><strong>The correction of the VIOLATION(S) is your responsibility, NOT that of the Association. Please make the necessary corrections prior to their re-inspection, which will be on or about Tuesday, June 04, 2024, to avoid the fine(s) imposed by the DCA upon re-inspection.<\/strong><\/li>\n\n\n\n<li><strong>The DCA will re-inspect (Tuesday, June 04, 2024, 9:00am-12:00pm) all units that were found in violation. Upon the initial re-inspection, if these violations have not been corrected, the DCA will levy a fine against the unit owner.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>What\u2019s Public vs. What\u2019s Private<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Public Records (Accessible from DCA):<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The&nbsp;<strong>original DCA inspection report<\/strong>.<\/li>\n\n\n\n<li>This often includes&nbsp;<strong>unit numbers<\/strong>&nbsp;and&nbsp;<strong>violations<\/strong>&nbsp;noted at each unit.<\/li>\n\n\n\n<li>Anyone can request it directly from the NJ DCA.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>BUT<\/strong>&nbsp;this report:<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Does&nbsp;<strong>not<\/strong>&nbsp;include how the&nbsp;<strong>HOA assigned fines<\/strong>.<\/li>\n\n\n\n<li>Does&nbsp;<strong>not<\/strong>&nbsp;specify&nbsp;<strong>how much each unit was charged<\/strong>\u2014because&nbsp;<strong>DCA doesn\u2019t fine individual unit owners.<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Private HOA Records:<\/strong><\/h3>\n\n\n\n<p><strong>&#8220;who was fined and for how much&#8221;<\/strong>&nbsp;\u2014 is&nbsp;<strong>not part of the DCA public record<\/strong>. It is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An&nbsp;<strong>internal HOA decision<\/strong>&nbsp;(how they calculated and passed costs to units),<\/li>\n\n\n\n<li>Tied to&nbsp;<strong>individual financial obligations<\/strong>, and<\/li>\n\n\n\n<li>Therefore,&nbsp;<strong>protected under privacy expectations and fiduciary duties.<\/strong><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Legal and Governance Reality:<\/strong><\/h3>\n\n\n\n<p>Anyone has access to the DCA report with unit numbers, the&nbsp;<strong>HOA is under no obligation<\/strong>&nbsp;to correlate that report with&nbsp;<strong>its own internal fine allocation<\/strong>&nbsp;on a unit-by-unit basis.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The&nbsp;<strong>DCA doesn&#8217;t issue individual fines<\/strong>\u2014it cites violations.<\/li>\n\n\n\n<li>The&nbsp;<strong>HOA decides how to allocate<\/strong>&nbsp;fines or repair costs based on the DCA report.<\/li>\n\n\n\n<li>Those allocations become part of&nbsp;<strong>owner financial or disciplinary records<\/strong>, which are&nbsp;<strong>not public<\/strong>&nbsp;under NJ law.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>DCA NJ DCA This is the State of New Jersey inspections.
