It’s time for our 3rd Annual Doggy Swim Day. 

Registration must be received no later than 09/06/2024 5:00pm

IMPORTANT:Every adult participant MUST complete a Release of Liability form.

Please read this document carefully and sign below.

Participants Please Note:

  • Each dog must have written proof of current vaccines. License tag or rabies tag will not be accepted. Puppies under the age of 4 months will not be permitted.
  • Dogs must be well behaved, sociable dogs; Aggressive dogs are not allowed. If a dog is observed to be aggressive, the owner must remove their dog from the premises immediately. Event staff will monitor the dog’s activities for any signs of aggression and enforce this rule.
  • Dogs that have an open cut, wound, or hair/skin condition or look ill will not be allowed.
  • Dogs must be wearing a flat collar (e.g., no metal collars).
  • A maximum of 1 dog to every 1 adult owner. The dog owner must always have control and oversight over their dog. The owner is expected to follow the rules of the event, sign the waiver, and remain with their dog throughout the event.
  • Dogs must be willing swimmers, with life jackets if needed.
  • Owners over the age of 18 may wade in the shallow end with their dogs, however, they will not be permitted to swim. No one under the age of 18 will be permitted in the pool.
  • All Berkshire Ridge Pool rules will be enforced.
  • BYOT–Bring Your Own Towel.
  • Walk dog directly before swim session -Clean up after your dog, bags and waste stations will NOT be available.
  • Berkshire Ridge HOA reserves the right to dismiss any dog or human for rule infraction unruly or aggressive behavior.

RELEASE OF LIABILITY

I hereby acknowledge that I voluntarily have applied to attend, with my dog(s), the Berkshire Ridge Doggy Swim 2024. I understand that the act of unleashing my dog(s) and being physically present inside the Berkshire Ridge Pool Facility necessarily involves risks of injury to me, my children, other people, my dog(s), and other dogs, which risks are entirely my responsibility. I expressly assume all these risks for myself and family members in attendance. I further understand that dogs, irrespective of their training and usual past behavior of characteristics, may act or react unpredictably at times based upon instinct of circumstances, and I agree to assume that this risk may result from aggressive, vicious, and dangerous dogs, which may be present at this event. Additional risks include, but are not limited to: dog fights, dog bites and injuries to humans and other dogs; dog theft or unlawful capture; dog escape over or under fences; plants and/or water sources in the park may be poisonous to dogs; Association vegetation may have burrs or seeds that could become tangled in a dog’s coat or lodge in a dog’s feet, ears, nose, or eyes; all of which might injure or infect your dog(s). I understand and expressly assume all additional risks.

I understand that Berkshire Ridge Homeowners Association does not assume liability for loss, damage, or any kind of injury sustained by any human or dog while attending the Doggy Swim 2024. Therefore expressly assume all risks associated with attending this event, as well as fixtures and equipment located therein, in an unsupervised manner.

By signing this release of liability and attending the Doggy Swim 2024, I hereby fully and forever release and discharge Berkshire Ridge Homeowners Association, and their agents from any and all claims, demands, damages, rights of action, or causes of action present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of my use or intended use of facilities or equipment. I fully and forever release and discharge the Berkshire Ridge Homeowners Association, and their agents from any and all negligent acts and omissions in the same and intended to be legally bound by this release.

I have carefully read this release of liability and understand and fully agree with its contents. I also have received acopy of the event rules for use for dog owners.
